Terms of Use

These Terms of Use ("Terms") govern your use of the CHIRPSTR mobile application and website (collectively, the "Service") operated by CHIRPSTR ("we," "our," or "us"). By using CHIRPSTR, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use CHIRPSTR. By creating an account, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate information when creating your account
• Keep your login credentials secure and not share them with others
• Notify us immediately at support@chirpstr.app if you suspect unauthorized access

3. The Service

CHIRPSTR allows you to record, store, and play back short audio messages ("chirps") during runs and races. Features available to you depend on your subscription plan:

• Free plan, access to core chirp recording and playback features with 30-day audio storage
• Pro plan, access to Race Mode, Kick Mode, unlimited playlists, custom intervals, and 1-year audio storage

4. Subscriptions and Billing

Pro plan subscriptions are billed through Apple's in-app purchase system. By subscribing, you agree to Apple's terms and conditions in addition to these Terms.

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal
• You can manage or cancel your subscription at any time through your Apple ID account settings
• Refunds are handled according to Apple's refund policy, we do not process refunds directly
• Prices may change with reasonable advance notice

5. User Content

You retain ownership of any audio recordings and content you create using CHIRPSTR. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely to provide the Service to you.

You agree not to record or upload content that:

• Is unlawful, harassing, abusive, threatening, or defamatory
• Infringes any third-party intellectual property rights
• Contains malware, spam, or other harmful code
• Violates any applicable law or regulation

6. Race Mode and Shared Links

Race Mode allows you to generate a shareable link that others can use to record audio messages for your race. By sharing a Race Mode link, you acknowledge that:

• Anyone with the link can record a chirp associated with your race
• You are responsible for who you share your race link with
• We are not responsible for content recorded by third parties via your shared link
• You may delete any chirp recorded for your race at any time

7. Acceptable Use

You agree not to use CHIRPSTR to:

• Reverse engineer, decompile, or attempt to extract source code from the app
• Use automated tools to access or scrape the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Create accounts for others without their knowledge or consent

8. Data Retention and Account Deletion

You may delete your account at any time from within the CHIRPSTR app. Upon deletion, all of your personal data, including audio recordings, profile information, and race data, will be permanently deleted from our servers within 30 days.

Audio recordings are subject to the retention limits of your plan (30 days for free, 1 year for Pro) and are permanently deleted when they expire. Deleting the app from your device does not delete your account or data.

9. Termination

We reserve the right to suspend or terminate your account at our discretion if we determine that you have violated these Terms or that your use of the Service poses a risk to other users or to the Service itself. If we terminate your account, we will notify you at the email address associated with your account where reasonably practicable.

10. Disclaimers

CHIRPSTR is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Service, including use during physical activity such as running, is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, CHIRPSTR and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction in the United States.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of CHIRPSTR after changes take effect constitutes acceptance of the updated Terms.
